Manning et. al Send Lawsuit vs. SkoreIt, BidRivals, UpBids to Court of Appeals, Adds BidStick to Suit

In February of 2011, Jill Manning, Theresa Bryant, Susan Snyder and Diane Elliott collectively filed suit against Swoopo’s Entertainment Shopping Inc., BidCactus.com, Beezid.com, QuiBids.com and BigDeal.com   Case: 1:11-cv-01013 QuiBids, BidCactus, Beezid Lawsuit penny auctions.

BigDeal and Swoopo have since shut down.

Then, in March of last year this same group filed suit against UpBids.com, SkoreIt, BidRivals, and BidSauce in 1:2011cv02203 filed in IL Northern District Court.

Their lawsuits allege that penny auctions are illegal gambling sites, games of chance.

Then, in February of this year the same group filed suit solely against QuiBids (case 5:2012cv00134).

Now, on Friday, April 27th, 2012, they came together again and brought a suit to the US Court of Appeals, 7th Circuit,  UpBids, SkoreIt, BidRivals and BidSticks (Pretty sure they mean Bidstick.com), notice how this suit excludes BidSauce.

International penny auction BidRivals.com has been offline since Thursday, a source tells us they are liquidating.

    I see that the article mentions that this is going to the court of appeals. Does this mean that the original lawsuit filed in Feb ’11 was struck down? I haven’t been able to find any news regarding this.

    Are these filers of these suits just doing this because they have had no winning bids at those sites or are they just filing on any penny auction site they become aware of? Claiming they are games of chance might fly or may not since the chance they are trying to claim as such is being able to be the final bidder when the timer runs out. Anyone can do this at any penny auction if they have enough bids. I just don’t see how that can be ruled as chance. Either you have enough bids to outbid all others or you don’t. Sure you can win other ways but just being able to win this one way disqualifies their claim in their suit. The appelate court will agree with the lower court is my opinion. Unless the plaintiffs have some other claim they can introduce.
